Part 10: Administration of Goods
Part 10: Administration of Goods
The goods of the Institute are the goods of the Church. Therefore the administration of them must be according to the Canon Law, following these norms of the Institute’s own law. The Institute as juridical person[345] has, according to the universal law of the Church, the right of purchasing, possessing, administering and selling temporal goods.[346]
The one ultimately responsible for all the goods of the Congregation is the Superior General.
All the goods of the Institute are administered by the General Treasurer who acts under the dependence of the Superior General.
The goods of the Institute, Provinces and Houses, are administered by the respective Treasurers, under the responsibility of the immediate Superior who will be informed of all the matters of his concern.[347]
The Treasurers are to give account of their administration to their Superior, who will report to the General Treasurer before the thirtieth of November. The local Ordinary has the right to know the financial situation of the houses of the Institute that exist in his territory.[348]
For the acquisition of resources, any licit way might be followed, provided that it is not in contradiction with the form of life of the Institute, which will be determined by the Directory. However, the Superior General will be able to make some exceptions consulting with his Council.
For the validity of any act of disposition or administration, which is significantly grave to the Institute, it will be necessary to ask for the written consent of the Superior General.
“Any appearance of luxury, immoderate profit and accumulation of goods is to be avoided.”[349]
Something is to be set aside, as means allow, for the needs of the Church and the sustenance of the poor.[350]
In case of dissolution of the Institute, the destination of its goods and patrimonial rights, as well as its debts, will be ruled by the universal law.
